Non-compete agreements are established by employers and employees to protect the employer’s trade secrets. These agreements are governed by the laws of many countries around the world. However, in Vietnam, the current law does not have clear provisions to regulate this issue. In this article, the author introduces the doctrine of inevitable disclosure that can be used as a theoretical basis for legislators to officially recognize the validity of the non-compete agreements in the near future.

Improving gender equality in the workplace is an urgent task for Vietnam Communist Party and the Government. Despite the ratification of international conventions on labour, women rights, as well as amendment to relevant domestic laws, it appears that the provisions have not satisfied the requirements set forth to combat discrimination at work against women.

Besides, a positive relation between the FDI intensity (in terms of the size of FDI in relative to the total capital resource) and the growth of employment in the domestic enterprise sector is found which implies that the relatively larger presence of FDI enterprises can have positive spillover effects on the domestic enterprise sector’s employment growth. However, the spillover effects of FDI are considered limited.

Objectives of this thesis are to perform a comprehensive, in-depth and systematic study on some theoretical issues on employers' right to labor management. Based on studied theoretical basis, the thesis focuses on analyzing actual state of current law on employers' right to labor management. By evaluation of inadequate points in current laws, the thesis proposes amendments and supplementations of some provisions on employers' right to labor management in Vietnam appropriate to labor market development in the context of regional and international integration.
