This Circular elaborates on the procedures for establishing, operating, amending, extending, and revoking licenses for representative offices (VPĐD) of foreign cooperation and research organizations in Vietnam, as mandated by Nghị định số 06/2005/NĐ-CP and its subsequent amendments. It specifically targets non-profit activities across various specialized fields such as science, technology, environment, health, and social affairs, outlining the scope of application and exclusions, notably for cultural/educational activities or organizations not directly supervised by foreign ministries. The document meticulously details the required conditions and documentation for each licensing stage, including application forms, organizational charters, program/project approvals, and biographical information for Chief Representatives. It also delineates the extensive inter-agency consultation process involving the Ministry of Foreign Affairs, various ministries, and provincial/city People's Committees to ensure comprehensive review and approval. Furthermore, the Circular defines the rights, obligations, and responsibilities of foreign representative offices, such as adherence to reporting requirements, staffing limitations, strict prohibition of profit-making activities, and respect for Vietnamese law and customs. Concurrently, it specifies the roles of Vietnamese state management agencies in guiding, supervising, and coordinating the activities of these foreign entities. This comprehensive framework aims to create a transparent, regulated, and supportive environment for international cooperation and research while safeguarding national interests.
