The body of property rights literature provides a general framework for analyzing the determinants of corporate share ownership structures.4 The literature emphasizes the roles of customs, social norms, and law and legal systems in shaping the structure of property rights and their governance systems. Corporate share ownership can be viewed as a property rights arrangement through which the owner of the share is entitled to three categories of property rights. Fragmentation of supervisory responsibility and loopholes in the legal definition of a “bank” allowed owners of banks and other insured depository institutions to shop for the regulator of their choice. Fourth, investment banks operated with insufficient government oversight. Money market mutual funds were vulnerable to runs. Additionally, the Foreign Investment Law and Foreign Investment Law Regulations regulate foreign investment. In Mexico, real property is classified as either public, private or communal, the nature of which will affect the property’s use and potential alienation.
