Governmentality identifies that regulation is constituted by micro instances of rule rather than by a centralised power or agent. Governmentality challenges the assumption that regulation is effected by centralised government over a constituency, arguing instead that regulatory practices exist everywhere, in the particular, such that macro regimes of rule can be deconstructed into their constitutive rationales and programs (Foucault, 1982, 1991; Dean, 1999).

This book has been written for those seeking an introduction to the basics of criminal law. It would be ideal if you are about to start a course in criminal law or if you just have a general interest in the subject. It does not at all purport to tell you everything you need to know about criminal law for a law degree, but hopefully it will pique your interest in the subject and introduce you to some of the main themes.

Crime and society’s responses to it, like virtually all social phenomena, are heavily influenced by issues of gender. Gender distinctions are made in deciding what activities are criminal. Gender significantly affects who commits crimes and what crimes they commit. Those involved in enforcing the criminal law—the police, other enforcement agencies, prosecutors, juries and judges—are influenced by gender in deciding who might have committed crimes, who ought to be prosecuted, whether they are, in fact, guilty and how they should be punished....

This text is unlike most traditional legal works and was prepared this way intentionally. Our teaching experience and feedback from students and educators alike gave us the strong sense that there was a need for something other than a traditional casebook approach to learning “con law.” While there is certainly a place for traditional texts, people with whom we consulted wanted a text that fell between basic civics books and law school-level casebooks to use in their introductory undergraduate courses on constitutional law or search and seizure.

Four decades have passed since the fi rst edition of this textbook. During the 1960s and 1970s, the Supreme Court waged a campaign to reform the criminal justice system through the selective incorporation of Bill of Rights safeguards into the Fourteenth Amendment. Having constitutionalized criminal procedure, the Supreme Court then elaborated a set of constitutionally mandated restraints on police behavior. The “goodness” or “badness” of a legal precept, nevertheless, depends on how well it works in practice. This can only be known through empirical validation.

The use of the Internet for terrorist purposes is a rapidly growing phenomenon, requiring a proactive and coordinated response from Member States. The United Nations Office on Drugs and Crime (UNODC) plays a key role in providing assistance to Member States, in furtherance of its mandate to strengthen the capacity of national criminal justice systems to implement the provisions of the international legal instruments against terrorism, and does so in compliance with the principles of rule of law and international human rights standards.
