Contract performance

This paper endeavours to give an analysis of contractual liability under the 2005 Vietnamese Commercial Law from the perspective of the CISG. By highlighting similarities and differences, the article aims to provide insights for Vietnamese businesses and judicial bodies in selecting and applying appropriate laws for contract formation, execution, and dispute resolution.

The primary objective of the research is to develop a balanced scorecard framework for construction contractors and measu re performance of contractors using that framework. The results of the questionnaire survey carried out and follow-up interviews conducted among 34 senior managers in Melbourne revealed that the above performance measurement framework is appropriate to use in a contracting organisation. The respondents perceive that the process management perspective measurement is more desirable than others.

This thesis provides empirical investigations into the behaviour of implied volatility quotes for currency options on the British pound/U.S. dollar (GBP/USD), the euro/U.S. dollar (EUR/USD), the Australian dollar/U.S. dollar (AUD/USD) and the U.S. dollar/Japanese yen (USD/JPY). The analyses are performed using dealer-quoted implied volatility and spot exchange rate datasets collected from the over-the-counter currency option market.

The ultimate aims of the study are to analyse of doctrine of contract performance upon unexpected changed circumstances, examine the provision of Vietnamese law, assess the application of this provision in a comparison with the provisions of international law and various national laws. Base on that, the study makes recommendations on revising law of changed circumstances and enhancing the implementation of this provision.
