The purpose of this paper is to explore a best practice framework for the regulation of payment services. It will discuss and assess some models as potential law reform concepts to be further developed. This paper will consider some possible models for the regulation of payment services involving the key elements of disclosure, minimum standards, prudential regulation and conduct licensing. It will also discuss supervision of the inter-bank payment system and a basic fair play regime. A possible regulatory model will be suggested as a contribution to future debate.

This paper applies a Bayesian model averaging algorithm to systematically evaluate the “law matters” literature and finds that the positive cross-country relationship between anti-self-dealing rules and stock market development proposed by Djankov, La Porta, Lopez-de-Silanes, and Sheifer (2008, Journal of Financial Economics 88: 430-465) is fragile. In contrast, proxies for information disclosure, political power of incumbents and economic development are found to have strong predictive power for stock market outcome variables.

We focus on four national characteristics to explain the size of the mutual fund industry across countries: law and regulation; demand characteristics; supply side factors; and the nature of the securities markets. Countries with a stronger judicial system, more stringent regulatory approval and disclosure requirements for funds tend to have a larger fund industry. This suggests that stronger regulation may be beneficial to the fund industry.

We used the information and elements required by the law, organizing them in different ways throughout the process to arrive at a final organization of the content that worked. We developed and tested a variety of designs, ultimately structuring the disclosure of information sharing practices in a table format.

The big challenge though is to show that education does make a difference to how people behave. Asking people at the end of a seminar whether they will do things differently is weak evidence.What people say they will do is known to diverge from what they actually do. “Good resolutions are useless attempts to interfere with scientific laws. On-time payments have a positive influence while late payments have a negative influence. However, the amount of positive influence a consumer receives from a timely payment may vary based on the type of creditor. For example, timely payments to a prime credit card lender may have a greater positive influence on a score than timely payments to a lender considered less favorable, such as a furniture or consumer electronics store.
