AMCs are, at times, weighed down by the number of schemes they offer or are under management (in some instances they are more than 200). This may result in a negative impact on the operational efficiency and profitability of the AMCs. The NFO boom that happened a few years ago has left behind a proliferation of schemes, some with overlapping objectives and investments. Yet, each scheme brings with it operational costs driven by regulatory, compliance and risk requirements.

Several filers reported suspected Ponzi schemes where subjects gathered client funds for investment in commercial real estate or real estate securities without actually purchasing the underlying assets. A hedge fund claimed to invest millions in CMBS and credit derivatives, but the filer found no evidence of CMBS ownership. The hedge fund primarily bought long-term certificates of deposit earning minimal interest, which were inconsistent with the fund’s investment strategy. In addition, the filer noted many small client deposits, consistent with a Ponzi scheme.

Mutual funds have been a significant source of investment in both government and corporate securities. Decades it has been the monopoly of the state with UTI being the key player, with invested funds exceeding Rs.300 bn. The state-owned insurance companies also hold a portfolio of stocks. Presently, numerous mutual funds exist, including private and foreign companies and mainly state- owned Banks. Foreign participation in mutual funds and asset management companies (AUM) is permitted on a case-by-case basis.
